There are many types of trusts to choose from in Colorado, including Living, Testamentary, Revocable, and Irrevocable. Contact (719) 624-4850(719) 624-4850 today and together, we will craft a document tailored to your life and assets..
Self-Proving Affidavit
Colorado residents do not need to include a self-proving affidavit when creating a will, although it is recommended. The testator and witnesses sign the affidavit as proof that the will was properly executed. Then, the affidavit is notarized and attached to the will. If you do not create a self-proving affidavit, your executor will need to locate at least one of the will’s witnesses to confirm the will’s validity. The witness might be required to appear in probate court. By creating an affidavit, probate will be faster and easier. Hammond Law Group can create this affidavit for you if you wish to include it with your last will and testament.
Can You Change An Existing Will?
You can change your will at any time, as long as you are of sound mind and doing so voluntarily. While you can amend an existing will, many people choose to create a new document when making changes. Making a new will invalidates the previous will. Contact us, your Colorado wills attorney, for help if you need to change your will or create a new one. We will help you make the changes to ensure they are legally binding.
Can You Change An Existing Trust?
If it’s a revocable trust, absolutely, yes. You can always modify a revocable living trust. In fact, as your life situation goes through changes (births, marriages, asset growth, etc.), it is a must to change your trust, too.
General Types of Trusts in Colorado Springs
- Revocable Living Trust – Allows individuals to own and control their property while alive, then transfer it to the trustee after death, while avoiding probate.
- Irrevocable Trust – An agreement among a settlor, trustee, and beneficiaries that cannot be revoked or amended. The trustor cannot take back property they transfer to an irrevocable trust. An irrevocable trust allows the person who creates the trust to manage their assets while avoiding probate and providing asset protection from future creditors. A Colorado Springs irrevocable trust can also help reduce estate taxes for those subject to the federal estate tax. Irrevocable trusts also protect the deceased estate from the creditors of their beneficiaries.
